However, Johnson’s attorney, Christopher Sandy, cited the deposition of DCI special agent Mark Ludwick, who stated that the search of athletes was illegal and that he was misled by other agents about the purpose of the investigation. Ludwick claimed that special agent Troy Nelson had informed him that the nature of the investigation was administrative, with the targets being online gaming operators like FanDuel and Draft Kings.

Ludwick reassured Lee that the focus was on the gaming operators and that no criminal consequences would arise from their statements regarding online gaming activities. Ludwick reported this interview to Nelson, who allegedly congratulated him “for obtaining a confession.” Ludwick eventually requested reassignment, stating that there was no geofence warrant and no reasonable suspicion to conduct the search. Brock’s attorney, Matthew Boles, also referenced Ludwick’s deposition in a motion, highlighting these concerning revelations.
